Attachment 3

Jim Haug, Applicant, presented information regarding his request for a sculpture studio and provided six (6) pages of photos and building renderings to Board Members.

Patty Hayes, Zoning Plans Examiner, presented:

-  photograph of the existing residential structure
-  plot plan of the property
-  plat map of the adjacent street areas
-  proposed location of the addition
-  location map
-  analysis of the application
-  applicant’s site plan with the area of setback encroachment
-  five findings of facts

Chair Adler opened the discussion for Board Members.

Member Dankwerth said she had walked across the street from the applicant’s residence and couldn’t see any view impact on the neighbor’s direct line of sight or toward the wash/open area.  She asked Ms. Hayes about neighbor input.  Ms. Hayes indicated that one neighbor contacted her to inquire about it, and he didn’t have an opinion either way.

Chair Adler asked Ms. Hayes about the heating, ventilation and air conditioning planned for the building addition.  Ms. Hayes advised that only Zoning Codes are being considered for this case.  Mr. Williams, Planning Manager, advised that the heating, ventilation and air conditioning plans are not factors involved with a decision for a variance.

Mrs. Hoag, Applicant, advised that their neighbor across the street said he didn’t have a problem with the proposal and offered to come to that meeting to advise Board Members of his support for the plan; however, he was not in attendance.

Chair Adler opened and closed the public hearing, as there were no people wishing to speak on the plan.

MOTION: A motion was made by Member Dankwerth and seconded by Member Bohl approve the variance request to reduce the front yard setback to sixteen (16) feet and the side yard setback to five (5) feet with the finding that all criteria have been met.

MOTION carried, 4-0.
