2.   Consider and approve the assignment and/or reassignment of office space to the District Attorney and County Clerk, each department will be responsible for the cost of relocation and renovation with no additional funds required.  County departments are authorized to assist with relocation, renovation and IT support to effectuate this change.  
  • 210 W. Philips space currently assigned to the County Clerk on the first floor will be transferred to the District Attorney. 
  • Vacant space in the Keeshan Building (301 N. Thompson St.) previously used by OAG Court will be assigned to the County Clerk.

2.   Consider and approve change order with Hagerty Consulting related to consulting services for the 2016 FMA, related to TWDB Contract 1600012123 to reflect previously approved performance period through November 2, 2025, and the contract to expire January 31, 2026, at no additional cost. R.   COUNTY ATTORNEY
 
1.   PRECINCT 1
 
a.   Approve Order Authorizing Notice of Public Hearing under Local Government Code Sec. 232.009(C-1) for a partial replat of Lexington Heights, Section 1, as recorded in Cabinet Z, Sheets 9314-9317 of the Montgomery County Map Records, to be known as Lexington Heights, Section 3. The purpose of the proposed partial replat is to reconfigure Reserve B of Lexington Heights, Section 1, in order to create 79 residential lots, 4 reserves, and 4 private right-of-ways.
 
2.   PRECINCT 2
 
a.   Approve Order Authorizing Notice of Public Hearing under Local Government Code Sec. 232.009(C-1) for a partial replat of Bluejack National Phase 1A as recorded in Cabinet Z, Sheets 3074-3088 of the Montgomery County Map Records and replat of Bluejack Southern Living Enclave as recorded in Cabinet Z, Sheets 6132-6133 of the Montgomery County Map Records, to be known as The Gardens Bluejack National. The purpose of the proposed partial replat is to abandon two (2) public utility easements and reconfigure Lots 1-7, Block 1 of Bluejack Southern Living Enclave, and to reconfigure lots 1-3, 8-10, and Reserve “U” of Block 10 of Bluejack National Phase 1A,  in order to create ten (10) residential lots and one (1) restricted reserve.

a.   Consider and approve Resolution and Order amending Temporary Construction Easement(s) previously approved on February 6, 2024, for a one-time drainage maintenance project in the Estates of Legends Ranch, including Attachment A, and authorize Precinct 3 Commissioner Ritch Wheeler or his designee to execute Temporary Construction Easement(s) on behalf of Montgomery County.

a.   Acknowledge receipt of Certificate for Payment No. 1a submitted by Waterstone Development Group LLC, on behalf of Crockett Meadows Public Improvement District. for Draw No. 1a; authorize and approve payment of the Actual Costs of the Improvement Area #1 Improvements in the amount of $3,192,959.53 from proceeds of the Special Assessment Revenue Bonds, Series 2025 (Crockett Meadows Public Improvement District Improvement Area #1 Project); and further direct Regions Bank, Trustee, to disburse the amount of $3,192,959.53 from the Improvement Area #1 Improvement Account of the Project Fund for credit to Crockett Meadows, LLC Operating in accordance with and pursuant to the terms of the Indenture of Trust between Montgomery County, Texas and the Trustee.

2.   Consider and accept the donation of a 2014 Dodge Ram, VIN 3C7WRSBL7EG133041 from the Montgomery County Hospital District. This vehicle will be used as our Drone Response Unit.
 
V.   GRANTS AND COMMUNITY DEVELOPMENT
 
1.   Consider and accept the Event Trust Fund award in the amount of $403,422 with a match of $64,548 from the Woodlands Township and approve the Trust Fund Event Support Contract with LGPA Tournament Properties One, LLC on behalf of LPGA, regarding the 2025 Chevron Championship Event and Event Trust Fund award.  The application was previously approved on December 10, 2024.  Authorize Judge Mark Keough to execute the agreement on behalf of Montgomery County.
 
2.   Consider and approve Letter Agreement with Montgomery County Fair Association regarding environmental services for the proposed Montgomery County Precinct 1 Community Center Project under HUD CDBG Entitlment Grant GY23/FY24 and certain future grant years as applicable.
 
3.   Consider and accept the Montgomery County HOME-ARP (HOME American Rescue Plan) Policies and Procedures.
 
4.   Consider and approve amendments to the 2023 Annual Action Plan, moving CDBG funds in the amount of $75,000 to Habitat for Humanity and $23,338.58 to the in-house demolition program, and moving HOME funds in the amount of $63,133.92 to Easter Seals for the down payment assistance program.  Please authorize County Judge Mark Keough to implement amendments including payments and reclassification of the Community Development budget as submitted.
 
5.   Consider, approve and authorize the Third Amendment to the FY20/FY21 CDBG Day Center Development Agreement, between Montgomery County and Compassion United, Inc., for the Miracle City Day Center Project, adding language in regards to NOTICE CPD-2023-12 issued November 2, 2023.  The Agreement was previously approved during the Commissioners Court meeting held on December 13, 2022.
 
6.   Consider and approve the FY 2026 First Responder Mental Health Project grant application and resolution to the Governor's Office of Texas in the amount of $27,216 for the Sheriff's Office.  $6,804 match from the Sheriff's Office Budget.  Please authorize Rebecca Ansley as authorized official and submit grant application electronically on behalf of Montgomery County.
 
7.   Consider and approve the FY2026 Crisis Intervention Project grant application and resolution to the Governor's Office of Texas in the amount of $172,678.81 for the Sheriff's Office.  No match required.  Please authorize Rebecca Ansley as authorized official and submit grant application electronically on behalf of Montgomery County.
 
8.   Consider and approve the FY2026 Crime Scene Investigation Equipment grant application and resolution to the Governor's Office of Texas in the amount of $37,458.38 for the Sheriff's Office.  No match required.  Please authorize Rebecca Ansley as authorized official and submit grant application electronically on behalf of Montgomery County.

12.   ANIMAL SERVICES
 
A.   Consider and approve increasing position 4100-4100, Chief Veterinarian from $162,800 to $172,800 and adding a tier 3 cell phone allowance, position is currently filled.   1. Change Order #13 to CSB Contractors, Inc., for Project #23–24 Renovations of the Ed Chance Courthouse Annex for additional items in the amount of $6,900.14 for Commissioner Precinct 3.
  2. Change Order #3 to iCON, LLC., for Project #23-18 FM 1484 Widening from FM 2432 to Rose Road for additional materials and adjustments in the amount of $71,465.76 for Commissioner Precinct 1.
  3. Change Order #3 to Gauge Engineering, LLC., for On-Call Engineering and Program Management Services for additional services in the total amount not to exceed $200,000 for Commissioner Precinct 4.
 
C.   Consider and approve a one-year extension for Project #19-08, Workers' Compensation and Property & Casualty Third Party Administration with AS&G Claims Administration, Inc. to include a 3% increase for Risk Management.
 
D.   Consider and approve to release the current lease and replace it with a new lease of space agreement with 552 Club (previously Houston Bunker, LLC.) for an additional leased space for a total of two spaces. This includes a one-time setup charge of $6,250 and a monthly charge of $10,950 for dual fiber optics and a monthly lease charge of $4,850 per month for a twenty-four (24) month lease effective March 1, 2025, for Information Technology. 
 
E.   Consider and approve the contract with the highly qualified provider, Professional Surveying and Engineering Services, per Government Code Chapter 2254, for the reconstruction of Nichols Sawmill Road (from Commerce Street to FM 1774) with Edminster, Hinshaw, Russ & Associates, Inc. d/b/a EHRA for the total amount of $237,977 for Commissioner Precinct 2.
