APPROVAL OF MINUTES

1.

Consider approval of the Minutes of the June 2, 2026 (Regular) Meeting. (Staff recommends approval of the item.)

OPEN FORUM/CITIZEN COMMENTS

This is the public's opportunity to address the City Council on any matter related to the City. In accordance with the Texas Open Meetings Act, Section 551.042, the City Council cannot discuss, consider, or take action on matters not listed on the agenda. The City Council will receive citizen comments on non-agenda items, and if necessary, may refer the matter to City staff for research, resolution or referral to Council on a future agenda. As described in the City's Public Meeting Procedures, comments will be limited to three (3) minutes.

CONSENT AGENDA

The items on the Consent Agenda are considered to be self-explanatory by the Council and will be enacted in one motion. There will be no separate discussion of these items unless requested by a Council Member.

1.

Consider approval of the acceptance of the public improvements for the Village at Gateway retail project (Staff recommends approval of the item.)

2.

Consider approval of a Resolution authorizing the City Manager to enter into a lease and maintenance agreement with DOCUmation for Xerox copiers for city departments. (Staff recommends approval of the item.)

3.

Consider approval of a Resolution authorizing the City Manager to enter into a Master Services Agreement No. 40976 between the City and MCCi and Addendum No. 1 thereto between the City and JustFOIA, Inc. for the procurement and implementation of the JustFOIA public information request management platform. (Staff recommends approval of the item.)

4.

Discuss and consider approval of a Resolution to authorize the City of Forney to submit a grant application to the Texas Water Development Board for the Water Supply and Infrastructure Grant, not to exceed $21 million, and authorize the Mayor and/or City Manager to sign all related documents for the application and grant, if funded. (Staff recommends approval of the item.)

Consider a change order for design services for the CIP 236 Northside Elevated Tank and Connecting Waterlines Project and all related issues. (Staff recommends approval of the item.)

6.

Consider approval of a right-of-way plat for Windmill Farms 4D Bozeman Drive, located south of Windmill Farms Boulevard and east of North F.M. 548. (Staff/Planning and Zoning Commission recommend approval of the item.)

7.

Consider approval of a site plan for a multi-tenant building, located north of the F.M. 741 and Monitor Boulevard intersection. (Staff/Planning and Zoning Commission recommend approval of the item.)

Discuss and consider approval of an Ordinance amending the City of Forney Code of Ordinances by amending the hours of construction activities. (Staff recommends approval of the item.)

Discuss and consider approval of a preliminary plat of lots 1-3, block 5, of the Village at Gateway Addition, located east of North Gateway Boulevard and north of U.S. Highway 80. (Staff/Planning and Zoning Commission recommend approval of the item.)

3.

Discuss and consider approval of a replat of lots 2A & 2B, block 2, of the Village at Gateway Addition, located east of North Gateway Boulevard and north of U.S. Highway 80. (Staff/Planning and Zoning Commission recommend approval of the item.)

4.

Discuss and consider approval of a Resolution authorizing the City Manager to apply for a State Infrastructure Bank (SIB) Loan Agreement with the Texas Department of Transportation (TXDOT) to relocate existing wastewater utilities along FM 1641. (Staff recommends approval of the item.)

5.

Discuss and consider approval of a Resolution authorizing an Interlocal Cooperation Agreement between the City of Forney and Talty Special Utility District to allow Talty SUD to provide interim retail water utility service to the Smurfit Kappa Coatings Facility and authorizing the City Manager to execute the Agreement. (Staff recommends approval of the item.)

6.

Consider a board and commission appointment: North Texas Municipal Water District Board for the Full-Term beginning June 1, 2026 and ending May 31, 2028. (Staff has no recommendation on the item.)

PURSUANT TO THE OPEN MEETINGS ACT, CHAPTER 551, TEXAS GOVERNMENT CODE, THE CITY COUNCIL WILL RECESS INTO EXECUTIVE SESSION (CLOSED MEETING) TO DISCUSS THE FOLLOWING:

RECONVENE INTO REGULAR SESSION [COUNCIL CHAMBERS]

IN ACCORDANCE WITH TEXAS GOVERNMENT CODE, CHAPTER 551, THE CITY COUNCIL WILL RECONVENE INTO REGULAR SESSION TO CONSIDER ACTION, IF ANY, ON MATTERS DISCUSSED IN EXECUTIVE SESSION.

Deliberate the appointment, employment, evaluation, reassignment, duties, discipline, dismissal of, or to hear a complaint against the public officer or employee (Tex. Gov't Code 551.074):

  1. North Texas Municipal Water District Board of Directors (Term 2026-2028)
2.

Deliberation regarding the deployment of security personnel or the implementation of security devices and systems, including the proposed acquisition of fixed video surveillance equipment for law enforcement purposes, in accordance with Texas Government Code § 551.076.

In addition to any executive session already listed above, the City Council of the City of Forney reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed on this agenda, as authorized by the Texas Government Code for the following purposes:

This agenda has been reviewed and approved by the City’s legal counsel and the presence of any subject in any Executive Session portion of the agenda constitutes a written interpretation of the Texas Government Code Chapter 551 by legal counsel for the governmental body and constitutes an opinion by the attorney that the items discussed therein may be legally discussed in the closed session portion of the meeting considering available opinions of a court of record and opinions of the Texas Attorney General known to the attorney. This provision has been added to this agenda with the intent to meet all elements necessary to satisfy Texas Government Code Chapter 551.144(c) and the meeting is conducted by all participants in reliance on this opinion.
