APPROVAL OF MINUTES

Consider approval of the Minutes of the June 23, 2026 (Special) Meeting. (Staff recommends approval of the item.)

OPEN FORUM/CITIZEN COMMENTS

This is the public's opportunity to address the City Council on any matter related to the City. In accordance with the Texas Open Meetings Act, Section 551.042, the City Council cannot discuss, consider, or take action on matters not listed on the agenda. The City Council will receive citizen comments on non-agenda items, and if necessary, may refer the matter to City staff for research, resolution or referral to Council on a future agenda. As described in the City's Public Meeting Procedures, comments will be limited to three (3) minutes.

CONSENT AGENDA

The items on the Consent Agenda are considered to be self-explanatory by the Council and will be enacted in one motion. There will be no separate discussion of these items unless requested by a Council Member.

1.

Consider approval of a Resolution for an Interlocal Agreement between the City of Forney and the City of Burleson. (Staff recommends approval of this item.)

2.

Consider action on a Resolution approving the expenditure by the Forney Economic Development Corporation (“FEDC”) of funds under a Professional Services Agreement (Interim Executive Director Services) with Justin Weiss, pursuant to Section 501.073(a), Texas Local Government Code. (Staff recommends approval of the item.)

3.

Consider approval of a Resolution authorizing an Interlocal Cooperation Contract between the City of Forney, Texas (Municipal Court) and the Texas Department of Public Safety for use of the Texas Conviction Reporting (TXCR) system, pursuant to Chapter 791, Texas Government Code (the Interlocal Cooperation Act), and Chapter 543, Subchapter C, Texas Transportation Code; and authorizing the City Manager to execute the Contract on behalf of the City. (Staff recommends approval of the item.)

4.

Consider approving an amendment to the Professional Services Agreement with KSA/Pape-Dawson Engineers to provide additional engineering services for the Community Park Roadway Extension, Roadway Bond Project. (Staff recommends approval of the item.)

5.

Consider approval of a site plan for Forney Marketplace Lot 2F, located north of U.S. Highway 80 and west of Marketplace Boulevard. (Staff/Planning and Zoning Commission recommend approval of the item.)

6.

Consider approval of a preliminary plat of the Forney Carwash Addition, located west of South F.M. 548 and north of the Forney Community Park entrance. (Staff/Planning and Zoning Commission recommend approval of the item.)

7.

Consider approval of a final plat for Ace Forney, located east of Lakewood Trail and north of South F.M. 741. (Staff/Planning and Zoning Commission recommend approval of the item.)

8.

Consider approval of a final plat of the Forney Carwash Addition, located west of South F.M. 548 and north of the Forney Community Park entrance. (Staff/Planning and Zoning Commission recommend approval of the item.)

9.

Consider approval of a final plat of the Fox Hollow Commercial Plaza Addition, located north of F.M. 741 and west of Monitor Boulevard. (Staff/Planning and Zoning Commission recommend approval of the item.)

10.

Consider approval of a replat of East Main Pine Addition, Block 45, Lots 1 and 2, located north of East Main Street and west of Chestnut Street. (Staff/Planning and Zoning Commission recommend approval of the item.)

PUBLIC HEARING ITEMS / ACTION ON PUBLIC HEARING ITEMS

1.

Hold a public hearing and discuss and consider an appeal of a Planning and Zoning Commission recommendation of denial for an Ordinance approving a conditional use permit for truck rental, auto leasing and outside storage to operate at 109 Industrial Drive (Planning and Zoning Commission recommends denial of the item.)

2.

Hold a public hearing and discuss and consider an appeal of a Planning and Zoning Commission recommendation of denial for an Ordinance to rezone 5.4 acres of property from Commercial District to Planned Development Overlay District with Data Center as an allowed use. The property is located on the east side of F.M. 1641 at the rear of property id 7797. (Planning and Zoning Commission recommends denial of the item.)

3.

Hold a public hearing and discuss and consider approval of an Ordinance to approve a conditional use permit for ‘Amusement Devices/Arcade’ to operate as a primary use at 140 Wildwood Boulevard. (Staff/Planning and Zoning Commission recommend approval of the item.)

4.

Hold a public hearing and discuss and consider approval of an Ordinance to approve a conditional use permit for ‘Auto Repair (Minor)’ and ‘Auto Tire Repair /Sales (Indoor)’ uses to operate at 200 West Broad Street. The request involves an expansion of the current use. (Planning and Zoning Commission recommends approval of the item.)

5.

Hold a public hearing and discuss and consider approval of an Ordinance to approve a conditional use permit for a ‘Cigar Lounge’ use to operate at 101 E. U.S. Highway 80. (Planning and Zoning Commission recommends approval of the item.)

X.

DISCUSSION / ACTION ITEMS

1.

Discuss and consider board and commission appointments: Animal Adoption Center/Shelter Advisory Committee; Board of Adjustments; Building Standards Commission; Capital Improvement Advisory Committee, Economic Development Corporation, Historic Overlay District Architectural Review Board; Park and Recreation Board; and the Planning and Zoning Commission. (Staff has no recommendation on the item.)

2.

Discuss and consider approval of funding for the Mulberry Park Four-Plex Renovations and Drainage Improvements. (Staff recommends approval of the item.)

3.

Discuss and consider directing initiating a text amendment to the City’s Zoning Ordinance (Section 37, Use Regulations) to remove “Data Center” as a conditional use in the Light Industrial (LI) district, as established by the Council’s April 21, 2026 Ordinance No. 26-12, amending Section 37, Section 38, and Section 49 of the Zoning Ordinance, and to prohibit data centers as a use in all zoning districts within the city limits, and provide staff direction on scope, process, and timeline for Planning & Zoning Commission and City Council consideration. (Item placed on the agenda at the request of Mayor Pro Tem Sarah Salgado and Council Member James Traylor. Staff has no recommendation on this item.)

PURSUANT TO THE OPEN MEETINGS ACT, CHAPTER 551, TEXAS GOVERNMENT CODE, THE CITY COUNCIL WILL RECESS INTO EXECUTIVE SESSION (CLOSED MEETING) TO DISCUSS THE FOLLOWING:

RECONVENE INTO REGULAR SESSION [COUNCIL CHAMBERS]

IN ACCORDANCE WITH TEXAS GOVERNMENT CODE, CHAPTER 551, THE CITY COUNCIL WILL RECONVENE INTO REGULAR SESSION TO CONSIDER ACTION, IF ANY, ON MATTERS DISCUSSED IN EXECUTIVE SESSION.

XV.

ADJOURNMENT

In addition to any executive session already listed above, the City Council of the City of Forney reserves the right to adjourn into executive session at any time during the course of this meeting to discuss any of the matters listed on this agenda, as authorized by the Texas Government Code for the following purposes:

This agenda has been reviewed and approved by the City’s legal counsel and the presence of any subject in any Executive Session portion of the agenda constitutes a written interpretation of the Texas Government Code Chapter 551 by legal counsel for the governmental body and constitutes an opinion by the attorney that the items discussed therein may be legally discussed in the closed session portion of the meeting considering available opinions of a court of record and opinions of the Texas Attorney General known to the attorney. This provision has been added to this agenda with the intent to meet all elements necessary to satisfy Texas Government Code Chapter 551.144(c) and the meeting is conducted by all participants in reliance on this opinion.
